Targeted Community Alternatives to Prison (T-CAP)

The Ohio Department of Rehabilitation and Correction (ODRC), Bureau of Community Sanctions (BCS) is soliciting interest from Ohio Counties who wish to participate in the Targeted Community Alternatives to Prison (T-CAP) grant in fiscal years 20-21. This grant provides funding to Ohio Courts of Common Pleas through Ohio County Boards of Commissioners, who submit a Memorandum of Understanding (MOU) pursuant to ORC §2929.34 and §5149.38. The purpose of this grant opportunity is to provide funds to local communities to effectively supervise, provide treatment services and hold accountable low-level, non-violent offenders in the community.

Expenditure Period: July 1, 2019 - June 30, 2022
Effective Date: July 1, 2019
Please note: Governor DeWine’s introduced budget for fiscal year 2020-2021 removes references to the “Target Counties” in ORC §2929.34 and §5149.38 which requires those ten counties to participate in the program and continues the program only for counties that elect to participate. See link to the Legislative Service Commission summary here. As a result of the proposed changes there are specific instructions for counties based on a county’s current status as either a Target county, a Voluntary County or a Non-participant County. Please be sure to review the “County Instructions” section for directions that apply to your circumstances.
T-CAP Grant Definitions
As used in this announcement:
1. "Target county" - Franklin county, Cuyahoga county, Hamilton county, Summit county, Montgomery county, Lucas county, Butler county, Stark county, Lorain county, and Mahoning county.
2. "Voluntary county" - any county in which the board of county commissioners of the county and the administrative judge of the general division of the court of common pleas of the county choose to submit an MOU in response to the T-CAP solicitation.
3. “Non-participant County” - A county that did not volunteer to participate in this grant during fy18 or fy19 and is not a Target county.
4. “T-CAP Target Population” - those Felony 5 offenders who are prohibited from serving a prison sentence in ODRC on and after July 1, 2018. Specifically, no person sentenced by the court of common pleas from a target county or from a voluntary county to a prison term that is twelve months or less for a felony of the fifth degree shall serve the term in an institution under the control of the department of rehabilitation and correction. This does not apply to any person to whom any of the following apply:
(i) The felony of the fifth degree was an offense of violence, as defined in section 2901.01 of the Revised Code, a sex offense under Chapter 2907 of the Revised Code, a violation of section 2925.03 of the Revised Code, or any offense for which a mandatory prison term is required.
(ii) The person previously has been convicted of or pleaded guilty to any felony offense of violence, as defined in section 2901.01 of the Revised Code.
(iii) The person previously has been convicted of or pleaded guilty to any felony sex offense under Chapter 2907 of the Revised Code.
(iv) The person's sentence is required to be served concurrently to any other sentence imposed upon the person for a felony that is required to be served in an institution under the control of the department of rehabilitation and correction.
5. “Grant Period” – time period within which a County receives T-CAP funds on a quarterly basis.
6. “Expenditure Period” – time period within which a County may expend T-CAP funds.
7. “Effective Date” – The date on or after which a "Target" or "Voluntary" county is prohibited from sentencing those T-CAP Target Population offenders from serving a prison sentence in ODRC.
ELIGIBILITY
All Ohio counties are eligible and encouraged to apply. ORC §5149.38 requires the submission of a Memorandum of Understanding (MOU) signed by a county commissioner representing the board of county commissioners of the county, the administrative judge of the general division of the court of common pleas of the county, the sheriff of the county, and an official from any municipality operating a local correctional facility which courts of the counties sentence offenders and which must include: (1) plans by which the county will use grant money provided to the county in state fiscal year 2019 and succeeding state fiscal years and (2) specifies the manner in which the county will address a per diem reimbursement of local correctional facilities.
Per ORC §5149.38 (B) Two or more target counties or voluntary counties may join together to jointly establish a MOU provided that the MOU is signed by each of the affiliating counties’ board of commissioners, administrative judge, sheriff, and official from any municipality operating a local correctional facility which courts of the counties sentence offenders.
GRANT REQUIREMENTS:
1. Counties must accept funding provided quarterly by electronic fund transfer. Counties may use the funding provided for a wide variety of community correction operational expenditures including costs associated with personnel, general operating expenses, program expenses (non-residential or residential) and equipment. Please see the T-CAP fiscal guidelines for specifics. Counties do not need prior approval from ODRC for any appropriate expenditure. Capital improvement expenses are not permitted. The funding amounts available by county for this grant are listed below.
2. Counties must submit quarterly fiscal expenditure reports throughout the grant period as instructed by ODRC per the T-CAP fiscal guidelines. The expenditure report is listed in those guidelines. Counties must provide supporting documentation of expenditures if requested by ODRC. Counties may expend funds received during the grant period until June 30, 2022. Once the County has expended all the funds received, fiscal expenditure reports are no longer required. If the County has not expended all funds by June 30, 2022, any remaining funds must be returned to the State of Ohio.
3. Counties will be required to sign a formal grant agreement if ODRC accepts the MOU.
County Instructions
PLEASE READ THE BELOW INFORMATION.
- IF YOUR COUNTY DID NOT PARTICIPATE IN THE T-CAP GRANT DURING FY18-19, PLEASE SEE THE NON-PARTICIPANT COUNTY SECTION.
- IF YOUR COUNTY IS ONE OF THE TARGET COUNTIES, PLEASE SEE THE TARGET COUNTY SECTION.
- IF YOUR COUNTY VOLUNTEERED TO PARTICIPATE IN THE T-CAP GRANT DURING EITHER FY18 OR FY19, PLEASE SEE THE VOLUNTARY COUNTY SECTION.
1. Non-participant County – The T-CAP grant and the T-CAP Target Population mandates do not currently apply to these counties. However, if a county chooses to submit a MOU prior to the deadline as a result of this solicitation, the county will become a Voluntary county beginning July 1, 2019. The T-CAP Target Population mandates will begin on that date thru June 30, 2021. The County will receive the grant fund amount listed in this solicitation as indicated during the biennium.
a. If the Non-participant County chooses not to reply to this solicitation there are no changes in its status. The T-CAP Target Population mandates would not apply to that county and no grant funds would be provided.
2. Target County – The T-CAP Target Population mandates and grant currently apply to these counties. As a result of the proposed changes in Governor DeWine’s introduced budget, see here, which eliminate the Target County requirement we are requesting that Target counties proceed as if the changes will be adopted by the General Assembly. As such, all Target counties have a choice to respond to this solicitation and submit a MOU.
a. If the Target County chooses to submit a MOU as a result of this solicitation, the county will continue to participate in the T-CAP grant during fy20-21, will receive the grant funding as indicated in this solicitation and the T-CAP target population mandates will continue to apply to the county thru June 30, 2021.
i. If the proposed changes to T-CAP are not adopted by the General Assembly and the statutes remain unchanged, the county will still be considered a Target county and mandated to participate, but since the county also submitted an MOU to participate, there is no change to the county. Meaning, the county has submitted an MOU for fy20-21, will receive the grant funds and the target population mandates remain thru at least June 30, 2021.
b. If the Target County chooses not to submit a MOU as a result of this solicitation, we will consider the county’s non-submission as its indication that it will not continue participation once the revisions to the statute eliminating the Target counties is effective. The effective date of the revisions should be 90 days after the budget bill is passed and signed by Governor DeWine. The T-CAP target population mandates will remain for the Target county until the effective date of the budget bill. Once that date has passed, the T-CAP target population mandates will no longer apply as the county elected not to volunteer during fy20-21. The county will not receive grant funds in fy20-21
i. If the proposed changes to T-CAP are not adopted by the General Assembly and the statute remains unchanged, the county is still considered a Target county and mandated to participate. The T-CAP target population mandates will remain in effect. However, since we are instructing Target counties to assume the proposed changes will be adopted, and the county subsequently chose not to submit an MOU, but are ultimately still mandated to participate, we will provide a second opportunity for the county to submit an MOU in order to receive the grant funds for fy20-21.
3. Voluntary County - The T-CAP Target Population mandates and grant currently apply to these counties. If the County chooses to submit a MOU prior to the deadline as a result of this solicitation, the county will continue to be a Voluntary county in fy20-21. The county will receive the grant funding as indicated in this solicitation and the T-CAP target population mandates will continue to apply to the county thru June 30, 2021.
a. If the Voluntary county chooses not to submit a MOU as a result of this solicitation, we will consider the county’s non-submission as its indication that it will not continue participation in fy20-21. The T-CAP target population mandates will cease on July 1, 2019 and the county will not receive grant funds in fy20-21.
DRC Response and Next Steps
Once the MOU is acceptable, ODRC will provide a written reply to the contact person listed in the MOU along with the T-CAP grant agreement for signature. When the grant agreement is returned to ODRC, the first quarterly payment will be provided to the County.
If the MOU is not acceptable, ODRC will communicate with the contact person listed on the MOU with further instructions. It is ODRC’s intent to fund all Counties who submit an acceptable MOU.

T-CAP FUNDING AVAILABLE BY COUNTY:
The amounts listed below are the intended total funding amount for the entire two-year grant period and will be paid in quarterly installments over the course of state fiscal year 2020 and 2021. The availability of funds for the T-CAP program is contingent on appropriations made by the Ohio General Assembly’s appropriation of the Community Non-Residential Felony Programs subsidy. Should those appropriations change, ODRC may reduce, suspend, or terminate any allocation it determines necessary.
